The Commission adjourned to meet Saturday, April 4, 1863, at 11 o'clock a. m.

CINCINNATI, Saturday, April 4, 1863.

The Commission met pursuant to adjournment. Members present, General Wallage, General Dana, General Tyler; also the judge-advocate and General Buell.

Major J. M. WRIGHT (a witness for the defense), being duly sworn by the judge-advocate, testified as follows:

By General BUELL:

Question. State your name and position in the service of the United Stated, if you please, major.

J. M. Wright; major and assistant adjutant-general of volunteers.

Question. Were you on duty with the Army of the Ohio from the time of its departure from Corinth in June last until General Buell was relieved from the command of that army? If so, please state in what position?

I was not on duty the whole of that time. Previous to the evacuation of Corinth I was taken sick, and did not rejoin the army until the 5th of July, at Huntsville, Ala. I was then on duty as assistant adjutant-general at headquarters.

Question. How many divisions of that army marched into North Alabama at that time?

Four divisions marched from Corinth.

Question. Name the divisions, if you please.

Second Division, General McCook; Fourth Division, General Nelson; Fifth Division, General Crittenden; Sixth Division, General Wood.

Question. Refer to the first morning report of that force after the 1st of July, and state what the effective strength of that force was.

I have a memorandum, taken from a Sparta report, which is more correct than these returns (referring to returns before the Commission), which gives the effective strength as 24,638.

Question. What is the date of those reports?

They were taken from those in the early part of July. I have not the reports themselves. They were at Nashville.

The JUDGE-ADVOCATE. I object to the introduction of this testimony without the original reports; I want the reports themselves. The question of General Buell refers to the official returns on the table and the witness proceeds to reply form memoranda which he has obtained from other reports which we have not here.

General BUELL. If there is any discrepancy I shall call upon the witness to explain it.

The WITNESS. From the reports (before the Commission) of the 10th of July the effective strength is 25,215. I see that this includes some cavalry regiments which were not permanently attached to the division. there is one attached to the Fourth Division, the Third Kentucky Cavalry, which is included in the report.

Question. Does that explain the discrepancy between the report that is now before you and the one from which you have made up your memoranda?

The difference between the two statements is 577. The Third Kentucky Cavalry numbered 547. These general consolidated reports have a great many inaccuracies in them, some of which I detected myself and corrected. I found a very important mis-
